1. Acceptance of Terms
These Terms & Conditions ("Terms") form a legally binding agreement between you and Zolby Solutions ("Zolby", "we", "us", "our") governing your use of all Zolby products and services, including:
- Zolby Website (www.zolbysolutions.com)
- Zolby Project (project.zolbysolutions.com and associated desktop/mobile apps)
- Any future Zolby apps (Analytics, Field, Docs, and others)
By clicking "Create Account", "Continue with Google", or otherwise accessing our services, you confirm that you have read, understood, and agree to these Terms, as well as ourPrivacy Policy.
2. Eligibility
- You must be at least 13 years old to use Zolby.
- If you are using Zolby on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.
- You must provide accurate, current, and complete information when creating an account.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@zolbysolutions.com if you suspect unauthorised access.
- You may not share your account with others or create accounts on behalf of others without their consent.
- Each account is for a single user (or a single company with named users under a Business/Enterprise plan).
4. Acceptable Use
You agree NOT to:
- Use Zolby for any unlawful purpose or in violation of any applicable laws.
- Upload, transmit, or distribute content that is illegal, defamatory, fraudulent, or infringes on intellectual property rights.
- Attempt to gain unauthorised access to other users' data or accounts.
- Reverse-engineer, decompile, or attempt to extract source code from our software.
- Use automated tools (bots, scrapers) to access or collect data from Zolby without prior written consent.
- Use Zolby to transmit spam, malware, or other harmful content.
- Overload or disrupt the infrastructure of Zolby or its providers.
We reserve the right to suspend or terminate accounts that violate these rules without notice.
5. Subscription Plans & Billing
Zolby Project is offered under the following tiers:

- Paid plans are billed monthly or annually (where offered).
- Prices are in USD unless otherwise stated for your region.
- You may cancel your subscription at any time; access continues until the end of the billing period.
- We do not offer refunds for partial billing periods, except where required by law.
- We reserve the right to change pricing with 30 days' prior notice.
6. Your Data & Content
- You own your data. All content you create in Zolby (projects, invoices, workflows, documents) remains your intellectual property.
- You grant Zolby a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the service to you.
- We do not claim ownership of, sell, or share your project data with third parties.
- You are responsible for maintaining backups of your important data. While we maintain our own backups, we cannot guarantee against data loss in all circumstances.
- Upon account deletion, your data will be permanently deleted within 90 days (except where legal retention obligations apply).
7. Intellectual Property
All Zolby trademarks, logos, software, source code, UI designs, and documentation are the exclusive property of Zolby Solutions. You may not copy, reproduce, modify, distribute, or create derivative works from any part of Zolby without our prior written permission.
Feedback, suggestions, or ideas you submit about Zolby may be used by us without compensation or attribution to you.
8. Privacy
Your use of Zolby is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the Privacy Policy.
9. Service Availability
- We aim for 99.5% uptime but do not guarantee uninterrupted service.
- We may perform scheduled maintenance (with advance notice where possible) or emergency maintenance at any time.
- We are not liable for losses caused by service outages beyond our reasonable control.
10. Disclaimer of Warranties
Zolby is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be error-free, that defects will be corrected, or that our servers are free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Zolby Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the service.
- Unauthorised access to or alteration of your data.
- Any third-party conduct or content on the platform.
- Any interruption, suspension, or termination of the service.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.
12. Indemnification
You agree to indemnify and hold harmless Zolby Solutions and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the service.
13. Termination
- By you: You may delete your account at any time from your account settings or by emailing support@zolbysolutions.com.
- By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.
- Upon termination, your right to use Zolby ceases immediately. Sections 6, 7, 10, 11, and 12 survive termination.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable laws. Any disputes shall first be attempted to be resolved amicably by contacting us at support@zolbysolutions.com. If unresolved, disputes shall be submitted to the jurisdiction of the courts applicable toZolby Solutions's place of registration.
15. Changes to These Terms
We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of Zolby after changes take effect constitutes your acceptance of the updated Terms.
If you do not accept the updated Terms, you must stop using Zolby and may request account deletion.
